Terms of Service

These Terms of Service ("Terms") govern your use of Tend ("the app"). The app is owned and operated by Sproutback, a sole trader business based in Australia ("Sproutback", "we", "us", "our"). By downloading or using the app you agree to these Terms. If you do not agree, do not use the app.

The app

Tend is a habit-tracking app with an optional companion pet. It is local-first: your data is stored on your device, and an account is optional. If you create an account, your data can be backed up and synced via our cloud provider. Use of your data is described in our Privacy Policy.

Your responsibilities

• You are responsible for the accuracy of the information you enter.
• You are responsible for keeping any account credentials secure.
• You agree not to misuse the app, attempt to break or interfere with it, reverse engineer it except to the extent permitted by law, or use it for any unlawful purpose.
• You are responsible for maintaining your own backups of important data. While the app provides export and (for account holders) cloud backup, we do not guarantee against data loss.

Accounts

You may use the app without an account. If you create one, you must provide accurate information and you are responsible for activity under your account. You may delete your account at any time, which removes your cloud-backed data as described in the Privacy Policy.

Subscriptions and purchases

This section applies if and when paid features are offered in the app. The app may not currently offer purchases.

• Some features may require a paid subscription. Prices and what each tier includes are shown in the app before you purchase.
• Purchases are processed by Apple through your App Store account. We do not receive or store your payment card details.
• Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period. You manage and cancel subscriptions in your App Store account settings, not in the app.
• Payment is charged to your App Store account at confirmation of purchase.
• Refunds are handled by Apple under the App Store terms; we generally cannot issue refunds directly.
• We may offer complimentary or promotional access to paid features to selected users at our discretion. Such access may be time-limited and may be modified or withdrawn.

Free and promotional access

Where we grant free or discounted access (for example to early users), that access is provided at our discretion, may be limited in time, and does not create an ongoing entitlement beyond the terms communicated at the time of the grant.

Intellectual property

The app, including its design, code, artwork, and content we provide, is owned by Sproutback and protected by law. We grant you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own personal use. The data you create in the app remains yours.

Disclaimers

The app is provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties that the app will be uninterrupted, error-free, or that data will never be lost. Tend is a habit-tracking tool, not medical, psychological, or professional advice; do not rely on it as such.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy you have under the Australian Consumer Law or other applicable law that cannot lawfully be excluded.

Limitation of liability

To the maximum extent permitted by law, Sproutback will not be liable for any indirect, incidental, or consequential loss arising from your use of the app, including loss of data. Where liability cannot be excluded but can be limited, our liability is limited to resupplying the app or the cost of doing so.

Termination

We may suspend or stop providing the app, or your access to it, if you breach these Terms or if we discontinue the app. You may stop using the app at any time by deleting it.

Changes to these Terms

We may update these Terms as the app changes. Continued use after an update means you accept the revised Terms. We will revise the "Last updated" date when we make changes.

Governing law

These Terms are governed by the laws of Australia and the state or territory in which Sproutback operates, without regard to conflict-of-law rules. The App Store's own terms also apply to your download and use of the app.
